Terms & Conditions
The following Terms of Business for events at the FeuerWerk constitute a component of the contract for the event which you (hereafter referred to as the “organizer”) have booked. Conditions of any other nature on the part of the organizer have no validity. The organizer agrees to these conditions, as well as to all pertinent commercial regulations and accepts liability for compliance with said regulations.
1. Guaranteed Number of Participants
For those events which will be catered, the FeuerWerk requires precise information as to the number of participants by no later than 4 working days prior to the event. This number shall be regarded as the guaranteed minimum number of participants, for which the FeuerWerk will make all necessary preparations. The organizer will be billed for this minimum amount no matter what the circumstances. Should the number of participants be greater than originally stipulated, the FeuerWerk will make every effort to cater to all participants, in so far as available capacity allows. Cover charges, foods and beverages which exceed the originally stipulated amount, will be billed additionally.
2. Cancellation of Events
If catered events are cancelled at least 96 hours prior to the start of the event, 50 % of the ordered meal price for the stipulated number of participants must be paid. If reservations for event rooms are cancelled, the following cancellation charges will apply:
up to 30 days prior to arrival 30 %
up to 14 days prior to arrival 60 %
up to 7 days prior to arrival 80 %
after this, 100 %
of the stipulated package price.
3. Service
We staff events with that number of employees which meets international quality standards. If, in order to comply with your special requests, additional staff shall prove necessary, this will be reflected in an additional fee of € 45 (incl. VAT) per employee and hour.
4. Technical Services
Provision of tables, chairs and seminar technology is included in the room rental charge (package pricing). For any additional basic work, such as construction of podia, runways, light or sound systems, or similar situations, we charge € 45 (incl. VAT) per person and hour. If your event requires complex technical work or equipment, which are not included in our standard room amenities, the FeuerWerk will contract with third-party businesses to conduct such work as necessary, the charges for which will be born by the organizer. The organizer shall abide by any safety-related instructions given to them by staff of the FeuerWerk.
5. Prices
Our prices include all taxes and service charges. These prices will continue to apply until superceded by a new price list.
6. Offers
Offers and programs which we have compiled remain the intellectual property of the FeuerWerk until such time as the contract is awarded. In the event that program we have offered is not booked with us, but rather is staged elsewhere, we do reserve the right to bill agent fees at market-standard rates.
7. Valuables
Valuables (also cash), which have been brought in by participants, can be deposited in the safe (depending on available capacity). In other instances, the FeuerWerk accepts no responsibility for such items. The organizer accepts responsibility for making participants aware of this option.
8. Beverages
Should no other arrangements have been made, all drinks will be billed according to actual consumption.
9. Food & Beverages brought in by the Organizer
The bringing in of foods and beverages requires the expressed permission of the FeuerWerk. A flat rate may be charged for doing so on the part of the FeuerWerk.
10. Music, Other Artistic Performances
If the organizer plans musical performances during the event, he is required to submit the required AKM- and entertainment tax-related reports in timely fashion. The organizer hereby indemnifies the FeuerWerk with respect to all damages as may result from failure to do so.
11. Decorations
The organizer is required to inform, and obtain the permission of the FeuerWerk with regards to intended installation of decorative materials or other items. In general, the mounting of decorations to interior features of the FeuerWerk, is not permitted. Installation must be completed by qualified personnel and in agreement with the management of the FeuerWerk. All fire regulations must be complied with. Decorative items provided by the FeuerWerk remain our property even after conclusion of the event. All costs relating to construction, installation and de-installation are borne by the organizer.
12. Liability
The organizer understands that, for safety reasons, smoking is expressly prohibited outside of the building and pledges to inform event participants of this fact. The organizer is himself liable for damages caused by guests, employees or agents of the organizer and the FeuerWerk shall be reimbursed in full for such damages. In certain instances, the FeuerWerk may require that the organizer procure an appropriate insurance policy. The FeuerWerk is only liable for damage of items brought into the hotel if it occurs due to the fault of third-party businesses.
13. Rescission of Contract
Management of the FeuerWerk is entitled, at any time and without having to provide reasons, to rescind the contractual relationship, if
a) the event endangers smooth business operations
b) the reputation or safety of the FeuerWerk is jeopardized, or
c) an instance of force majeure occurs.
In no circumstance is the organizer entitled to assert claims for damages against the FeuerWerk.
14. Billing
The invoice will be issued on the day the event concludes. Bills are payable in full within 14 days. In the event of late payment, 15 % late-payment penalties will be charged. By entering into a agreement with us, the contractor expressly agrees to accept all procedural charges in the event of unpunctual payment.
15. Jurisdiction and Applicable Law
Laws of the Republic of Austria shall apply. Innsbruck is stipulated as the competent seat of jurisdiction.
